Australia Sues Amazon Over Prime Video Ads, Alleging Unfair Contract Terms

    Why Has Australia Sued Amazon?

Australia’s consumer watchdog has launched legal proceedings against Amazon, alleging the company breached consumer protection laws by introducing advertisements to its Prime Video streaming service through unfair contract terms affecting more than one million subscribers.

The Australian Competition and Consumer Commission (ACCC) claims Amazon relied on unfair contractual provisions between November 1, 2023, and August 18, 2025, allowing it to alter the Prime Video service without providing refunds or meaningful compensation to subscribers.

    What Are the Allegations?

According to the ACCC, Amazon introduced advertisements on Prime Video in early 2024 and required customers to pay an additional monthly fee to retain an ad-free viewing experience. At the time, more than 850,000 Australians had already prepaid for annual Prime memberships.

The regulator alleges Amazon included five unfair contract terms that enabled the company to make materially adverse changes to its services without giving subscribers a contractual right to refunds or other meaningful remedies.

    How Has Amazon Responded?

Amazon said it is reviewing the lawsuit and will respond through the legal process.

“We have cooperated with the ACCC throughout its investigation and remain focused on providing the best experience for our Australian customers,” an Amazon spokesperson said.

    Why Does the Case Matter?

The lawsuit adds to growing global scrutiny of Amazon’s consumer practices. In the United States, the Federal Trade Commission has pursued legal action over alleged deceptive Prime subscription practices, while UK regulators have investigated the company’s online marketplace practices, including product listings and fake customer reviews.
